NicheGaps

Terms of Service

The rules for using NicheGaps, paying for Pro and getting refunds, in plain language.

1. Agreement

These terms are an agreement between you and NicheGaps ("we", "us"), based in Portugal, for using nichegaps.com, its API and any related services (together, the "Service"). By creating an account, paying for Pro or otherwise using the Service, you accept them. If you use the Service for an organisation, you confirm you may bind it to these terms.

If you don't agree, please don't use the Service. The privacy policy explains how we handle your data and is part of these terms.

2. What NicheGaps is

NicheGaps collects public complaints and requests (app store reviews, forum posts and discussions), groups the ones that describe the same unmet need into opportunities, and scores them. Grouping, summaries and scores are produced automatically, partly by AI models. They are informed estimates, not facts: they can be incomplete, out of date or wrong, including in ways that sound confident.

We may change, add or remove features, sources and scoring methods, and suspend the Service for maintenance. We'll try to give notice of significant changes.

3. Not business, financial or legal advice

Nothing on NicheGaps is business, investment, financial, legal or tax advice. An opportunity is a signal worth checking, not a promise that a product will find customers or make money.

You are responsible for your own research and for every decision you make with what you find here, including building, funding or launching a product.

4. Accounts

  • Give accurate information and keep your email address current.
  • Keep your password safe. You're responsible for activity under your account; tell us at [email protected] if you think someone else has access.
  • You must be at least 16 to create an account.
  • One person per account. Don't share an account or a Pro plan.

5. Free and Pro

  • Free lets anyone browse every opportunity, open the top-ranked ones in full and see a preview of the signals behind the rest.
  • Pro opens every quote and signal for every opportunity and adds the watchlist. What Pro includes is listed where you buy it. Features can improve, but we won't remove a listed Pro feature during a period you've paid for without refunding the time left.
  • Technical limits, such as how many requests can be made per minute, apply to everyone to keep the Service fast and stable.

6. Payments and renewals

Payments are handled by Stripe; we never see or store your full card number. Prices are shown before you pay, including any tax that applies where you live.

  • Monthly and yearly plans renew automatically at the end of each period and charge the payment method on file until you cancel. Cancel any time from your account; Pro then stays on until the end of the period you've paid for.
  • A day pass is a single payment for 24 hours of Pro. It doesn't renew.
  • If we change a price, active subscribers get at least 30 days' notice by email before it applies to their next renewal, and can cancel before then.

7. Cancellation and refunds

When you subscribe or buy a day pass, you ask for Pro to start right away, so you can use it immediately. Cancelling a subscription stops its renewals. Refunds work like this:

  • Cancelling within 14 days (consumers in the EU, EEA and UK). You can cancel within 14 days of your first payment for a plan or a day pass, and we refund the part that hasn't run yet. This right ends once the paid time has fully run, so a day pass can't be cancelled after its 24 hours. It covers a subscription's first payment, not its renewals.
  • Our mistakes. Duplicate or accidental charges are refunded. If Pro didn't work for a significant part of your paid time because of a problem on our side, we extend it or refund the affected time, whichever you prefer.
  • Otherwise payments, renewals included, aren't refundable, except where the law where you live requires it. Cancel before a renewal if you don't want it.

To ask for a refund, email [email protected] from the address on your account, or ask in the support chat. Refunds go back to your original payment method. Please contact us before disputing a charge with your bank: it's usually faster, and we may pause Pro while a dispute is open. Billing questions should be raised within 30 days of the charge.

8. Acceptable use

Use the Service lawfully and only as these terms allow. Don't:

  • scrape, crawl or bulk-download opportunities, signals or scores, or rebuild our dataset, except through the RSS feed and features we offer for that;
  • resell, sublicense or republish NicheGaps's data or analysis as a product or dataset without our written permission;
  • get around plan limits, rate limits or access controls, or share Pro access with others;
  • probe, scan or test the Service's security, or overload, disrupt or reverse engineer it;
  • use quotes from the Service to identify, contact, harass or target the people who wrote them;
  • send spam, malware or unlawful content through the support chat or contact form, or impersonate someone else.

Breaking these rules can lead to suspension or closure of your account without a refund of the current period.

9. Third-party content and sources

Signals quote short passages that people published publicly on the App Store, Google Play, the Shopify App Store, Reddit, Hacker News and similar sites, and link back to the original. Those words belong to their authors and are governed by the platforms' own terms. We show them as evidence for research and commentary; we don't claim ownership of them, and reviewers' names aren't shown.

NicheGaps is not affiliated with, endorsed by or sponsored by Apple, Google, Shopify, Reddit, Y Combinator or any product named on the site. Product names and trademarks belong to their owners and are used only to identify those products.

If you wrote something we quote and want it removed, or you believe content on the site infringes your rights, email [email protected] with the page link. We review every request and remove content where it's justified.

10. Our content and your licence

The Service, including its software, design, opportunity write-ups, scores and the way signals are selected and grouped, belongs to us and is protected by intellectual property law.

We give you a personal, non-exclusive, non-transferable licence to use the Service for your own research and your own business decisions. You may quote individual opportunities or small excerpts with a link back to NicheGaps. Anything beyond that needs our written permission.

If you send us feedback or ideas, we may use them without owing you anything.

11. Support chat

The chat on the site is answered first by an AI assistant, which can make mistakes; what it says doesn't change these terms or create commitments. When it can't help, a person on our team takes over. Chats are stored so we can answer and improve support, as described in the privacy policy. Don't share passwords or payment details in the chat.

12. No warranty

The Service is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted, error-free or fit for a particular purpose, or that opportunities, scores, summaries or quotes are accurate, complete or current.

13. Limitation of liability

To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits, revenue, data, goodwill or business opportunities, or for decisions you make based on the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim.

Nothing in these terms limits liability that can't be limited by law, such as for fraud or for death or personal injury caused by negligence, or your rights as a consumer under mandatory law.

14. Indemnity

If you use the Service for business, you agree to cover our reasonable costs and losses from claims by others that arise from your breach of these terms or your misuse of the Service.

15. Suspension and closing accounts

You can stop using the Service at any time and ask us to delete your account (see the privacy policy). Cancel any subscription first.

We may suspend or close accounts that break these terms, don't pay, or put the Service or other people at risk. Unless the breach is serious or the law prevents it, we'll tell you why first. If we close an account without such a reason, we refund the unused part of any paid period. Sections that by their nature should survive (content ownership, no warranty, liability, law) survive the end of these terms.

16. Law and disputes

These terms are governed by Portuguese law. If you're a consumer, you also keep the protection of the mandatory laws of the country you live in and can bring a claim in your local courts.

Consumers can also file a complaint in the electronic complaints book at livroreclamacoes.pt, or take a dispute to an alternative dispute resolution body such as CNIACC, the national arbitration centre for consumer disputes, at cniacc.pt.

If something goes wrong, contact us first at [email protected]. Most problems can be solved quickly, and we'll try in good faith to settle any dispute informally within 30 days before either side goes to court.

17. Changes to these terms

We may update these terms when the Service, its prices or the law change. The date at the top shows the current version. For significant changes we give notice on the site at least 14 days before they apply, and email you if you have Pro. If you don't accept a change, stop using the Service before it applies and we'll cancel your subscription and refund the unused part of the time you've paid for.

18. General

  • These terms and the privacy policy are the whole agreement between you and us about the Service.
  • If part of these terms can't be enforced, the rest still applies, and that part is applied as closely to its intent as the law allows.
  • Not enforcing a right straight away doesn't mean we give it up.
  • You can't transfer your account or these terms to someone else without our consent. We may transfer them to a company that takes over the Service, and will tell you if we do.

19. Contact

Questions about these terms: [email protected], or the chat button on any page. We aim to answer formal legal notices within 10 business days.
